Because we own the exhibition and the huge ready-made electronic platform (MIXXIA) that contains and displays through it the latest, most luxurious and most luxurious original international brands .. of women's bags, personal collectibles, accessories, etc. Users can interact between them in a friendly, easy and lovely way .. Our Authentication system (Entrupy) is used to make sure that items are inspected and authenticated. So please read the terms of service carefully before entering and browsing the company's website, given that simply entering and using our website, applications, or other products and services in any form ... is your prior and explicit consent to all of these terms and is representative An approved electronic signature saved in our electronic system.
PLEASE READ THESE TERMS OF SERVICE CAREFULLY. THESE TERMS INCLUDE A MANDATORY ARBITRATION PROVISION AND CLASS ACTION WAIVER PROVISION, WHICH AFFECT YOUR RIGHTS ABOUT HOW TO RESOLVE ANY DISPUTE WITH MIXXIA, LLC. BY ACCESSING OR USING OUR WEBSITE, APPLICATIONS OR OTHER PRODUCTS OR SERVICES (TOGETHER, THE “MIXXIA SERVICE”), YOU AGREE TO BE BOUND BY ALL TERMS DESCRIBED HEREIN AND ALL TERMS INCORPORATED BY REFERENCE (“TERMS”). IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT ACCESS OR USE THE MIXXIA SERVICES.
YOU ACKNOWLEDGE AND AGREE THAT THERE ARE RISKS ASSOCIATED WITH UTILIZING AN INTERNET-BASED MARKETPLACE AND INTERACTING WITH OTHER USERS IN PERSON.
These Terms apply to your access to and use of the MIXXIA Service provided by MIXXIA, LLC. (“MIXXIA,” “we” and “us”). Additional terms (including, but not limited to, the terms of social media services, third-party payment processors, and third-party fulfillment providers) may apply to particular functionalities and features related to the MIXXIA Service.
Note: From time to time MIXXIA introduces new features that may only be available to certain users. Provisions of these Terms of Service relating to such new features, including, at the present, the electronic payments and fulfillment solutions, may not apply to all users.
1. Eligibility
ONLY USERS WHO ARE SEVENTEEN (17) YEARS OF AGE OR OLDER MAY REGISTER FOR OR USE THE MIXXIA SERVICE. The MIXXIA Service is not targeted towards, nor intended for use by, anyone below the country’s LEGAL age. If you are below the country’s LEGAL age, you may use the MIXXIA Service only under the supervision of a parent or legal guardian who agrees to be bound by these Terms and any applicable additional terms. You further represent and warrant that you: (a) have not previously been suspended or removed from using the MIXXIA Service; (b) are legally permitted to, and do, live in Kuwait or GCC, and (c) may enter into this agreement without violating any other agreement to which you are a party. If you are registering to use the MIXXIA Service on behalf of a legal entity, you further represent and warrant that (i) such legal entity is duly organized and validly existing under the applicable laws of the jurisdiction of its organization, and (ii) you are duly authorized by such legal entity to act on its behalf.
2. Account Registration and Security Responsibilities
In order to access certain parts of the MIXXIA Service, you may be required to create a MIXXIA account (an “Account”). In connection with creating an Account, you must provide certain information (“Registration Data”) and answer all questions or fields marked “required.” You agree to: (a) provide true, accurate, current and complete Registration Data; (b) maintain and update such Registration Data to keep it true, accurate, current and complete; (c) maintain the security of your Account, including by maintaining the security and confidentiality of your login credentials; and (d) consent to allow MIXXIA to contact you for the purpose of confirming some or all of your Registration Data, to conduct research and to resolve disputes, as MIXXIA may elect to do from time to time.
3. Purchases From Other Users.
A. Payments Determined by Users. A buyer may, by agreement with the seller, elect to make payment by K-Net , Payment Gateway or Credit Card. Such payments are made directly between the buyer and the seller when they meet in person to complete their purchase and sale transaction, pursuant to terms they determine. MIXXIA is not a party to such transactions, and does not facilitate such transactions, refunds or returns in any manner.
B. MIXXIA App Service. A buyer and seller may instead pay with and accept credit cards and other electronic payment methods (each an “Electronic Payment Method”) through MIXXIA. MIXXIA has integrated with TAP, a payment processing service, to allow sellers to accept certain Electronic Payment Methods from buyers using TAP’s payment processing services (“MIXXIA Payment Solution”). MIXXIA, in its sole discretion, may from time to time impose limits on your ability to make and/or receive payments through the TAP Payment Solution. Additionally, TAP may impose its own limits and limitations on a seller’s use of the MIXXIA Purchase and Payment.
i. Buyers. As with any purchases made using Electronic Payment through the MIXXIA Payment Solution, the seller processes your Electronic Payment Method using TAP’s payment processing service. MIXXIA is not a party to purchase and sales transactions completed using the TAP Payment Solution, and disclaims any and all responsibility to facilitate such transactions.
ii. Sellers. By using the MIXXIA Payment Solution to accept Electronic Payment Methods, you are entering into an agreement with TAP subject to the terms of the , which includes the (collectively, the “TAP Services Agreement”). Notwithstanding anything to the contrary in the TAP Services Agreement, you will not have the right to have TAP, and will not request that TAP, transfer any buyer data TAP collects via the MIXXIA Payment Solution to an alternative payment processor. Except for the foregoing restriction that supersedes any rights you may have in the TAP Services Agreement, the TAP Services Agreement is separate from these Terms. MIXXIA is not a party to the TAP Services Agreement and will not be liable or responsible for the payment services provided by TAP. If TAP discontinues providing services in connection with the MIXXIA Payment Solution, you authorize TAP to share your payment method information with an alternative third-party payment processor that is or will be integrated into the MIXXIA Payment Solution.
iii. Seller Fees. You agree to pay the service fees (“Service Fees”) for the sales transactions you make using the MIXXIA Payment Solution. The Service Fees include Electronic Payment Method processing fees to TAP and service fees to MIXXIA. MIXXIA reserves the right to change the Service Fees from time to time.
iv. Receiving Sales Proceeds. Upon completion of a sale in which the buyer uses the MIXXIA Payment Solution, if you have not previously set up a TAP Account, then you must set up a TAP Account in accordance with the requirements specified by TAP to receive the payment via the MIXXIA service. TAP MUST ACCEPT YOUR APPLICATION TO USE MIXXIA SERVICE BEFORE YOU CAN RECEIVE SALES PROCEEDS VIA MIXXIA SERVICE. IF TAP REJECTS YOUR APPLICATION, THEN TAP MAY DISABLE OR LIMIT YOUR ABILITY TO RECEIVE SALES PROCEEDS VIA MIXXIA APP SERVICE.

v. Acceptable Use Violations. YOUR RIGHT AND/OR ABILITY TO RECEIVE SALES PROCEEDS VIA MIXXIA SERVICE MAY BE REVOKED, DISABLED OR LIMITED IF THE PURCHASE OR SALE VIOLATES MIXXIA (ACCEPTABLE USE) OF THESE TERMS, INCLUDING FOR SALES THAT VIOLATE THE PROHIBITED ITEMS GUIDELINES.
4. Returns & Refunds.
A. MIXXIA users can return used items only for whatever reason, but have to pay fees that might include Shipping and Authentication fees. When a user intends to return an item must state the reason to MIXXIA salesman by specifying the reason electronically. New items cannot be returned unless it is different from the original item purchased from MIXXIA app.
B. By accepting MIXXIA terms & conditions, the seller accepts and agrees to receive returned items back. The Seller is responsible for any misuse or violation of MIXXIA rules including any false information related to any listed item by the seller.
C. MIXXIA is not responsible for any information and the conditions of any product posted by the seller. Buyer has the right to report or sue the seller directly to the public authority within the country’s laws & rules.
D. When rejecting a used item for whatever reason, the money will be refunded once confirmed by MIXXIA.
E. Refunds will be done through the TAP Payment gateway system.
F. Buyer must decide whether to accept the used item or reject it by the time of MIXXIA driver arrival, and that is out the door and within 5 minutes only. The item CAN NOT be taken inside the house otherwise it will be considered as accepted and no refund is allowed.
5. Chat & Bargaining.
A. For security purposes, users are not allowed to exchange and send personal emails, phone numbers, credit cards information or home addresses in MIXXIA chat for any purposes.
B. Users will be fully responsible for any false information given to users in MIXXIA chat. Whether it is related to the item or not, the user is responsible for any further consequences by the law.
C. Users are not allowed to threaten, swear, harass or have a conversation not related to posted items in MIXXIA app.
D. MIXXIA has full rights to access chat conversations at any time for safety purposes.
6. Posting Item's Photo.
A. The seller is fully responsible for posting an item in MIXXIA app, including item’s photos taken by the user(whether from phone gallery or from MIXXIA app camera), item’s information and item’s prices.
B. Users are extremely prohibited from posting photos other than the bag. By agreeing MIXXIA Terms and Conditions, the user is fully responsible for every item’s photo posted.
C. MIXXIA has the right to reject, block and/or report users to the public authorities.
D. MIXXIA has the right to claim financial compensation from users.
7. Feedback
Any comments or materials sent to us, including, but not limited to, ideas, questions, comments, suggestions, feedback or the like regarding the MIXXIA app Service or any other products or services of MIXXIA (collectively, "Feedback"), is non-confidential and will become our sole property. We will have no obligation to you of any kind, monetary or non-monetary, with respect to such Feedback and will be free to reproduce, use, disclose, exhibit, display, transform, create derivative works from and distribute the Feedback to others without limitation or obligation. You waive any rights you may have to the Feedback (including any copyrights or moral rights). Further, you agree not to submit any feedback that is defamatory, illegal, offensive or otherwise violates any right of any third party, or breaches any agreement between you and any third party.
